Aristotle, De Partibus Animalium, 673a8-9 No reader of the Iliad can fail to be struck by the great extent to which social relations among the gods resemble those which obtain among men. Zeus, the oldest and strongest of the Olympian deities, rules as an absolute monarchor patriarch. The "council" meetings (...) over which he presides are not unlike those which occur on earth. Like Agamemnon, he must assert his authority from time to time; and, like any mortal king, he must deal with problems relating to jealousy, adultery, dishonesty, and revenge. To the extent that the gods differ from mortal heroes, those differences are similar to the ones which separate mortal heroes and commoners. The gods occupy the highest place on the scale of excellence, beauty, and social status, mortals with divine ancestry occupy the next position, and so on down the line. Although the above picture is accurate in many respects, there is something about it which is bound to leave one cold, for, unlike his mortal heroes, Homer's gods often appear as clowns. One need only recall scenes like Hephaestus' bumbling attempt to wait on the other immortals (1.584 ff.), Hera's seduction of Zeus (14.157 ff.), or the famous theomachy (21.385 ff.) to see that, ironically, humans frequendy are more dignified than the gods they are trying to please. It was scenes like these which caused Longinus, in his essay On the Sublime, to remark that Homer appears to have made his men gods and his gods men (sec. 9). Now any long story is bound to contain comic relief. But for many authors (Shakespeare, for instance), comic relief is supplied by those whose social status is lower than that of the main characters, e.g., grave diggers, nightwatchmen, country bumpkins, or pettythieves. As Aristotle argued in the Poetics (sec. 2 and 5), comedy is an imitation of men worse than the average. In Book 2 of the Iliad, Homer does use Thersites 295 296Philosophy and Literature for comic effect; yet this scene is noteworthy for being the only one in the book which supports Aristotle's contention. In practically every other case, comedy is supplied by characters better than the average: it is supplied by the gods. Moreover, in the few cases where mortal aristocrats are involved in comic situations (e.g., the rambling speeches of Nestor), the teasing tends to be extremely mild. Farce and slapstick are reserved almost exclusively for the inhabitants of Olympus. Plato, for one, was outraged by passages where the gods look ridiculous and wanted them excised from the text. Not surprisingly, there is a tradition of modern scholars who feel a similar sense of outrage. Walter Leaf, for example, maintained that the theomachy is poorly written and thus not the work of Homer.1 Gilbert Murray argued that several of the scenes in question are in bad taste, exemplify the spirit of Milesian skepticism, and, again, are not the work of Homer.2 Wilamowitz constructed an elaborate theory which claimed that these passages are the work of a later rhapsode who probably was associated with Archilochus.3 Finally, George Calhoun, who exposed the flaws of those just mentioned, concluded that such passages show the influence not of a later period of skepticism but of an earlier, less refined period and were composed merely to please Homer's audience.4 Since it is not my purpose to enter the long debate over the authorship and unity of the text, let me state the guiding assumptions of this essay dogmatically. First, the passages in question are not interpolated and serve important artistic functions. Second, for whatever reason Homer decided to include them, their presence raises profound moral and religious questions. From the outset, it is clear that any anthropomorphic conception of the gods will have to fail in one important respect. The gods are immortal, humans are not. Robert R. Reilly’s America on Trial: A Defense of the Founding argues that the intellectual roots of the founders’ political theory are found in the Christian understanding of man, society and the world, and in the tradition of natural law thinking that emerged under its aegis. The American founding, he concludes, must be understood as an attempted “re-establishment” of “the principles and practices” of medieval constitutionalism. While finding the broad outlines of Reilly’s argument persuasive, the author worries that Reilly does (...) not adequately take into account the eclectic character of the founders’ thought, the influence of the Enlightenment and Reformation on it, and the long-term implications of the latter influences for the historical trajectory of public order they created. The contrast between Reilly’s understanding of the founding and John Courtney Murray’s more nuanced account, the article argues, underscores both the strengths and weaknesses of this book. While both Reilly and Murray would agree that the founding was “good,” Murray, unlike Reilly, recognizes that “the seeds of dissolution” were present from the beginning and worries whether it is ultimately “good enough” to sustain the American experiment in self-government and ordered liberty. James L. Kastely. New Haven, CT: Yale University Press, 1997. Pp. viii + 293. $30.00. In Rethinking the Rhetorical Tradition, James Kastely presents an alternative to the "standard" rhetorical tradition; he calls this alternative skeptical rhetoric, describes its characteristic activity as (...) refutation, and claims for it special relevance in negotiating postmodern challenges to rhetoric, specifically, that it can serve as a "refutation of postmodernism" (23). This alternative tradition inheres in a canon of works somewhat different from the standard canon, and an examination of key works organizes most of the chapters in this book. To establish and articulate this tradition in the classical era, Kastely examines Plato's Gorgias and Meno, Sophocles' Philoctetes, and Euripides' Hecuba; he then moves to the modern era, and to two works that address themes central to ancient rhetorical skepticism: Jane Austen's Persuasion (1818) and Jean-Paul Sartre's What Is Literature? (1949). Finally, Kastely turns to the two prongs of the postmodern reappropriation of traditional rhetoric, the tropological formalism of Paul de Man and the ideological approaches of Marxist critics such as Terry Eagleton, challenging both of them with the comic skepticism of Kenneth Burke.The skeptical tradition begins with Socrates, of course. It takes as its central problem, not the impossibility or contingency of knowledge, but the existence of injustice. In a political community, the unavoidability of doing inadvertent injury both requires rhetoric and at the same time makes it party to continued injustice: "[D]oing injury is an inescapable aspect of a being who is born into a world that is shaped by a language and by conventional practices that embody a particular set of values" (42). It is these prior commitments and conventional practices that, Kastely argues, lead us to cause injury. Thus, the positive task of rhetoric is not to persuade others away from injustice or to promote remedies; it is to keep us constantly open to refutation, to the possibility of seeing an alternative to the inadvertent wrong we commit. The inherency of injustice is what makes rhetoric a philosophical problem, but refutation is what rhetoric can offer to philosophy (a claim that might surprise philosophers). And in his reading of the Meno, Kastely argues explicitly for a rhetorical, rather than philosophical or logical, understanding of refutation.Overall, Kastely offers us a Plato who is not the enemy of rhetoric, but rather "the most sophisticated and profound rhetorical theorist" (30), who dramatizes in dialogue the philosophical dilemma of rhetoric. In [End Page 179] Sophocles and Euripides, he finds dramatists who illustrate practical forms the dilemma can take, specifically the problem of the unavailable audience. In the Philoctetes, the problem is how to regain the trust and confidence of the marginalized and disenfranchised, how to restore the status of rhetorical audience to one who no longer believes that justice is possible. In the Hecuba, the problem is how a disempowered rhetor can speak to the powerful. In both plays, but especially in Hecuba, the proximity of rhetoric to violence is a practical consequence of the unsolved philosophical problem.Kastely admits that the skeptical legacy from classical rhetoric has had little effect since antiquity. His argument that this alternate tradition deserves recognition is made primarily by his chapters on Austen and Sartre. He sees the works he examines here as raising a question central to rhetorical skepticism: "Can there be a way of speaking and writing that can effectively challenge the marginalization and dehumanization of people in a world in which traditional structures of authority that made discourse coherent have vanished or, at least, are seriously and irretrievably eroded?" This paper sets out to put Kenneth Burke’s thought on language as representative of symbolic action into conversation with Aimé Césaire’s epic poem, Cahier d’un retour au pays natal. The paper is divided into three main sections that set the stage for Burke and Césaire’s work to converse. The first section lays out an overview of Kenneth Burke’s thought on language paying particular attention to his definition of man, understanding of symbolism and symbolic action, and thoughts on poetry (...) and poetics. The second section provides a working history of African philosophy, the Négritude movement, Césaire as a philosopher, politician, and poet, and provides an overview of main themes and intentions present in Cahier. The third section works to put Burke and Césaire into conversation by using Burke’s understanding of symbolic action and his notion of order and identification to examine key passages from Césaire’s Cahier. Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

In ‘‘The Myth of Original Intentionality,’’ Daniel Dennett appears to want to argue for four claims involving the familiar distinction between original (or underived) and derived intentionality.

This book assesses and defends Kant's Critical epistemology, and the rich yet neglected resources it provides for understanding and resolving fundamental issues regarding human experience, perceptual judgment, empirical knowledge and cognitive sciences. Kenneth Westphal first examines Kant's methods and strategies for examining human sensory-perceptual experience, and then examines Kant's central, proper, and subtle attention to judgment, and so to the humanly possible valid use of concepts and principles to judge particulars we confront. This provides a comprehensive account of Kant's (...) anti-Cartesianism, the integrity of his three principles of causal judgment, and Kant's account of disciminatory perceptual-motor behaviour, including both sensory reafference and perceptual affordances. Westphal then defends the significance of Kant's subtle and illuminating account of causal judgment for three main philosophical domains: history and philosophy of science, theory of action and human freedom, and philosophy of mind. Focusing on the ground-breaking and often controversial science of Charles Darwin, the author seeks to bridge the gulf between science and religion on the subject of human evolution.

The scope of this study is both ambitious and modest. One of its ambitions is to reintegrate Hegel's theory of knowledge into main stream epist~ology. Hegel's views were formed in consideration of Classical Skepticism and Modern epistemology, and he frequently presupposes great familiarity with other views and the difficulties they face. Setting Hegel's discussion in the context of both traditional and contemporary epistemology is therefore necessary for correctly interpreting his issues, arguments, and views. Accordingly, this is an issues-oriented study. I (...) analyze Hegel's problematic and method by placing them in the context of Sextus Empiricus, Descartes, Kant, Carnap, and William Alston. I discuss Carnap, rather than a Modern empiricist such as Locke or Hume, for several reasons. One is that Hegel himself refutes a fundamental presupposition of Modern empiricism, the doctrine of "knowledge by acquaintance," in the first chapter of the Phenomenology, a chapter that cannot be reconstructed within the bounds of this study. Kant famously declares that “although all our cognition commences with experience, … it does not on that account all arise from experience”. This marks Kant’s disagreement with empiricism, and his contention that human knowledge and experience require both sensation and the use of certain a priori concepts, the Categories. However, this is only the surface of Kant’s much deeper, though neglected view about the nature of reason and judgment. Kant holds that even our a priori concepts are acquired, not from (...) sensation, but “originally,” because our mind has a fundamental capacity to judge that, upon sensory stimulation, generates the Categories through its basic logical functions of judgment. Westphal argues that focussing on these differences, however, occludes a decisive, shared achievement: a distinctive constructivist account of the basic principles of justice which justifies their strict objectivity without invoking moral realism nor moral anti- or irrealism. Westphal explores how Hume developed a kind of constructivism for basic property rights and for government, and how Kant greatly (...) refined Hume's construction of justice within his 'metaphysical principles of justice', whilst preserving the core model of Hume's innovative account. Despite the accumulation of substantial cognitive science research relevant to education, there remains confusion and controversy in the application of research to educational practice. In support of a more systematic approach, we describe the Knowledge-Learning-Instruction (KLI) framework. KLI promotes the emergence of instructional principles of high potential for generality, while explicitly identifying constraints of and opportunities for detailed analysis of the knowledge students may acquire in courses. Drawing on research across domains of science, math, and language learning, we illustrate the (...) analyses of knowledge, learning, and instructional events that the KLI framework affords. We present a set of three coordinated taxonomies of knowledge, learning, and instruction. For example, we identify three broad classes of learning events (LEs): (a) memory and fluency processes, (b) induction and refinement processes, and (c) understanding and sense-making processes, and we show how these can lead to different knowledge changes and constraints on optimal instructional choices. Building on his previous study of the role of natural law in Hume's and Kant's accounts of justice, Westphal argues that Hegel developed and justified a robust form of civic republicanism. Westphal identifies, for the first time, the proper genre to which Hegel's Philosophical Outlines of Justice belongs and to which it so prodigiously contributes, which he calls Natural Law Constructivism, an approach developed by Hume, Rousseau, Kant, and (...) Hegel. He brings to bear Hegel's adoption and augmentation of Kant's Critique of rational judgment and justification in all non-formal domains to his moral philosophy in his Outlines. Westphal argues that Hegel's justification for the standards of political legitimacy successfully integrates Rousseau's Independence Requirement into the role of public reason within a constitutional republic. In these regards, Hegel's moral and political principles are progressive not only in principle, but also in practice. Hegel's Civic Republicanism will be of interest to scholars of moral philosophy, social and political philosophy, philosophy of law, Hegel, eighteenth- and nineteenth-century philosophy. (shrink)

The three presumptions that Hegel’s idealism further develops or radicalises Kant’s transcendental idealism, that their respective versions of idealism are linked by Kant’s account of self-positing (Selbstsetzungslehre) in the late opus postumum and that the basic model of Hegel’s early idealism holds also for his mature system are wide-spread and largely unexamined. This paper examines several problems confronting these presumptions, including Hegel’s refutation of the basic premises of Kant’s transcendental idealism and Transzendentalphilosophie in the late opus postumum (§2), Hegel’s critical (...) rejection of intellectual intuition because it cannot escape Pyrrhonian scepticism (§3), and his critical rejection of the deductivist ideal of scientia, which undergirds Kant’s transcendental idealism and his late Transzendentalphilosophie (§4), the highly un-Kantian principles of Hegel’s mature idealism (§5) and finally Hegel’s thorough and incisive critique in the 1807 Phenomenology of Spirit of common philosophical views, concepts and presuppositions, including those which undergird the three presumptions noted above (§6). To understand properly Hegel’s philosophy of nature and hence also his philosophical system requires abandoning those three presumptions. (shrink)

Despite extensive examination of Kant’s Transcendental Idealist account of freedom of action, an important question has been neglected about why and how Kant can use two distinct models of human action when considering any particular human act. The present paper examines and answers this question, revealing neglected yet important points about Kant’s account of action and its understanding and assessment.

The apparent implications of the latest findings of the life sciences for our freedom and autonomy are both exciting and controversial: They undermine a common view of human freedom: a fundamentally Cartesian view. A superior account of our freedom was developed by Kant and Hegel. Key features of Hegel's account show that we can expect from the life sciences further insights into the biological basis of our freedom and autonomy, but not their repudiation. I begin with basic features of Cartesian (...) self-transparency (II) and then review three findings of contemporary life sciences (III). I then detail key features of Hegel's anti-Cartesianism (IV), in order to formulate the basic question about our freedom posed by the claim that biology explains away human freedom (V). I criticize this biological determinism by drawing upon Hegel's account of human freedom as autonomy (VI), and comment briefly on biologism in moral theory (VII). (shrink)

Rejection of the philosophical relevance of history of philosophy remains pronounced within contemporary analytic philosophy. The two main reasons for this rejection presuppose that strict deduction is both necessary and sufficient for rational justification. However, this justificatory ideal of scientia holds only within strictly formal domains. This is confirmed by a neglected non-sequitur in van Fraassen’s original defence of ‘Constructive Empiricism’. Conversely, strict deduction is insufficient for rational justification in non-formal, substantive domains of inquiry. In non-formal, substantive domains, rational justification (...) is also, in part, ineliminably social and historical, for sound reasons Hegel was the first to articulate. Demonstrating this involves considering closely two key reasons many analytic philosophers (still) reject the philosophical relevance of historical philosophy (§2). As specific example of presumed, though fallacious, deductivism about justification in the non-formal domain of empirical knowledge is found in van Fraassen’s (1980) defence of ‘Constructive Empiricism’ (§3). These first two sections contend that philosophical consideration of historical philosophy is required to properly formulate key issues in non-formal domains. I next consider the further issues involved rational justification in non-formal domains, issues quintessentially posed by the Pyrrhonian Dilemma of the Criterion (§4). Finally I consider what kind of history of philosophy is required for cogent philosophy in non-formal domains (§5). (shrink)

For Leo Strauss, the superiority of classical political philosophy over modern social science (and political theory based on social science) lies in at least four principles. First, it treats political matters as they actually appear to man qua philosopher and, in a qualified way, to the good citizen. Because Strauss claims that social science (and much post-classical political philosophy) abstracts from his canon of intelligibility, he thinks that it cannot lead to a humane, rational politics. (See "What is Political Philosophy?", in What is Political Philosophy? [Westport: Greenwood], pp. 27-28, and "Distinction between Facts and Values" in Natural Right and History [Chicago: Univ. of Chicago Press, 1953], pp. 78-80.) Second, Plato and Aristotle believed that only the good man properly judges politics. This belief attracts Strauss, because it identifies virtue as the best claimant to political rule. ("What is Political Philosophy? ", pp. 36-38.) A third principle is derived immediately from this second: politics ought to be organized hierarchically. In the hierarchy, either the truly virtuous or gentlemen should rule, and those having a passive, obediential form of virtue should be the ruled. Fourth, this arrangement is rational and humane. For although the virtues of the ruler and the ruled are complementary in justice and necessary to it, still they are different and, in fact, require the stratification just mentioned. BOOK REVIEWS 527 Because of the controversial nature of these principles and Strauss's eminence in political philosophy, one welcomes the present collection of essays by his disciples. They believe that in liberal democracies people confuse liberty with the uses to which liberty can and ought to be put. Doing so, people undermine that regime's foundations. Strauss and his disciples believe that modern natural right makes the clash between liberty and natural right inevitable, because its principal founders, Thomas Hobbes and John Locke, conceived man as non-political. They conceived individuals as gaining certain advantages from governments hut as gaining no good in the exercise of politics itself. Classic natural right, by contrast, bases itself on the assumption that man is radically political. Moreover, it conceives politics as an arena for liberating, ennobling activities. Hobbes and Locke viewed the individual as independent of politics, which they placed at the low end of the range of human activity, along with everyday concerns and popular morality, rather than at the high end, as Strauss would. Thus for Strauss, liberal democracy is founded on modern principles, which are either apolitical and liberal (Locke) or apolitical and illiberal (Hobbes). Consequently, it cannot withstand the individualist and collectivist onslaughts that we have seen in this century. What, then, have Strauss's disciples to say about liberal democracy and the prospect of classic natural right in a Western world which is more or less permanently Hobbesian-Lockean? This can be answered by describing first the hook's divisions and then its diagnoses and prescriptions. According to Kant, justifying the application of mathematics to objects in natural science requires metaphysically constructing the concept of matter. Kant develops these constructions in the Metaphysical Foundations of Natural Science (MAdN). Kant’s specific aim is to develop a dynamic theory of matter to replace corpuscular theory. In his Preface Kant claims completely to exhaust the metaphysical doctrine of body, but in the General Remark to MAdN ch. 2, “Dynamics,” Kant admits that once matter is reconceived as basic forces, it (...) is no longer possible to construct the concept of matter. I argue that Kant’s admission is only the tip of the problem, and that none of Kant’s commentators has fully grasped the problems infecting the MAdN that underlie Kant’s admission. I show that Kant’s proof that matter consists of forces is fallacious. I then re-analyze the circularity in Kant’s definition of density, criticizing both Adickes’ formulations and his later dissolution of it. I also show that a third circularity infects the relations between Kant’s treatment of “Dynamics” and “Mechanics” (MAdN ch. 3). These three fundamental problems demonstrate the untenability of Kant’s metaphysical method, and they require the radical revision of the relation between mathematics and metaphysics Kant undertakes in his opus postumum. I show that some of Kant’s most surprising and critical later claims about the Critical philosophy are correct, and that they require the sorts of remedies Kant contemplates in the opus postumum. The First World War was supposed to end all wars, though soon followed WWII. Since 1945 wars continued to abound; now we confront a real prospect of a third world war. Many armed struggles and wars arise in attempts to end repressive government; still more are fomented by repressive governments, few of which acknowledge their repressive character. It is historically and culturally naive to suppose that peace is normal, and war an aberration; war, preparations for war and threats of war (...) belong to ‘normal’ human life. Our tolerance, acceptance or fostering of such repeated injustices and atrocities indicate pervasive failures to understand fundamentals of justice, and what we owe morally to ourselves and to all others, together with our responsibilities to preserve the biosphere, not merely our own store(s) of reserves. As matters both of justice and prudence we must re-orient ourselves, individually and collectively, to promote justice, peace and ecological responsibilities by identifying and instituting just forms of social cooperation, domestically and internationally. All of these are our problems, whether we recognize them or continue our pervasive negligence. We urgently require cogent understanding of the social dimensions of human judgment, rational assessment, right action, and public reason. This requires understanding (inter alia) how Kant’s explication of rational judgment and justification is fundamentally social, how these features of rational judgment and justification are constitutive of Kant’s account of individual autonomy, and how they are central to Kant’s account of proper public use of reason. Reasoning publically remains precarious, not because – as often alleged – the ‘Enlightenment project’ has failed. It has not failed, it has been thwarted, and in our public responsibilities we have too often failed it. (shrink)
